Manchester board rejects settlement in lawsuit with former codes director

The Manchester Board of Mayor and Aldermen voted 4-3 on Wednesday to reject settling a lawsuit brought against the city by former Codes Director Paul Guess.

Aldermen were split 3-3 on the question, with Mayor Betty Superstein casting the tie-breaking vote. A judge ruled in October that the city had violated Guess’ due process when it voted to fire him in December, 2008, in an unannounced item on the board’s agenda, and later after a hearing in January, 2009.

In a letter to City Attorney Gerald Ewell dated Oct. 16, Guess’ attorney, J. Stanley Rogers offered a settlement proposal.
